يهدف هذا الكتاب إلى استعراض مسائل حماية الحياة الشخصية في العصر الرقمي، وبالتالي حماية البيانات المتعلقة بالحياة الشخصية من مخاطر المعالجة الإلكترونية، وهو ما يتطلب عرضا للدواعي والأسباب التي أوجدت هذا المفهوم وتحديداً مخاطر تقنية المعلومات على حياة الأفراد الخاصة.
لأجل هذه الغاية، قامت المؤلفة بدراسة اجتماعية وقانونية هامة وضرورية وبعيدة النظر، إذ أننا نتجه بسرعة كبيرة إلى مستقبل من الواجب توقّعه والتحضير له، وأن مجتمعاتنا العربية بأمسّ الحاجة إلى الانطلاق مما ملكت وتعظيم ما تملك وهي تحاول أن تتلمس موطئ قدم في خضم التغيير المتسارع.
تتضمن الخصوصية كمفهوم على التالي: أولاً حق الفرد بالحماية المادية لحياته وممتلكاته، وثانياً على حق حماية قيمه وعناصره المعنوية، وثالثاً على حقه بالحماية العامة من جميع الاعتداءات على حياته الشخصية، فاندرج بالتالي من ضمنه، حق الفرد في السيطرة على المعلومات والبيانات الخاصة، والذي بات وجوده ضرورة حديثة تتطلبها "مواجهة تحديات العصر الرقمي".
تبحث الكاتبة في هذه الخصوصية، وفي الإشكاليات والمخاطر الناتجة عن تحديات العصر المعلوماتي، وفي استراتيجيات وتقنيات الحماية منها تقنياً وتنظيمياً وقانونياً، وتعرض "مدى الحاجة إلى سد النقص من خلال قواعد قانونية وقائية جديدة تلائم متطلبات المعلوماتية".
يقسم مضمون الدراسة إلى، قسم أول وفيه بحث مفصّل عن "الحياة الشخصية بين الماضي والحاضر، وعن مخاطر المعالجة الآلية للبيانات الشخصية على الحريات العامة، وفيه شرح مسهب لوظائف بنوك المعلومات وعلاقتها بالحياة الشخصية، وللأساليب التقنية المستخدمة في التعدي على الحياة الشخصية. أما القسم الثاني فيبحث في جميع أنواع الوسائل الضرورية لحماية الحياة الشخصية في مجال المعلوماتية، كما في تفاصيل النظام القانوني لذلك منطلقاً من مبادئ حماية البيانات الشخصية، ومن الحماية الجزائية للحياة الشخصية.
يتضمن هذا الكتاب معلومات قيّمة وبحث ذو أهمية وفائدة كبيرتين، يظهر مدى الحاجة الملحّة "إلى التوفيق بين ضرورة وأهمية وفائدة نظم المعلومات، وبين تفادي ما يمكن أن يصيب الفرد من أضرار في حرمة حياته الخاصة، من ممارسة هذه النظم لنشاطها مما يقتضي تدخل رجل القانون في البحث عن الحماية القانونية الفعّالة للحياة الخاصة والحقوق الشخصية."
