عرف سلاطين المماليك وأمراؤهم نظام الوقف كما عرفه ومارسه سادتهم من سلاطين بنى أيوب لذلك تأثر نظام الوقف عندهم بنظام الوقف الذي كان سائداً في العصر الأيوبي، يضاف إلى ذلك ظروف العصر المملوكي السياسية والاقتصادية، والتي أدت إلى ازدهار الاوقاف، وبالتالي اهتمام سلاطين المماليك بها، فوضع السلطان بيبرس- على سبيل المثال- تنظيماً جديداً للاوقاف اختلف بمقتضاه ولأول مرة مدلول لفظ الاحباس عن مدلول لفظ الاوقاف في مصطلح الدواوين.
وأدى ازدهار الاوقاف وكثرتها في العصر المملوكي إلى أن أصبحت معظم دور وحوانيت ورباع مصر والقاهرة موقوفة، فضلاً عن ما يقرب من نصف مساحة الأراضي الزراعية، لذلك لعب نظام الوقف دوراً هاماً بارزاً في الحياة الدينية والسياسية والاقتصادية والاجتماعية في العصر المملوكي.
ولا ينكر الباحث صعوبة البحث عن جذور وأصول وأسس نظام الوقف الذى كان معروفاً في مصر في العصر المملوكي، ولعل تلك الصعوبة ترجع إلى أن المصادر التاريخية المتداولة اهتمت أساساً بالحياة السياسية وأغفلت اغفالاً يكاد يكون تاماً- في بعض الأحيان- كل ما يتعلق بنظام الاوقاف. فاقتصرت معظم هذه المصادر التاريخية على ذكر الاوقاف عند الحديث عن مناقب أحد السلاطين أو الأمراء. ونظرت هذه المصادر التاريخية إلى الأوقاف كوجه من وجوه الاحسان، والقربة إلى الله، ولم تنظر إلى الأوقاف ودورها الهام في حياة المجتمع.
لهذا كان على الباحث أن يجمع جهد شذرات بسيطة عن نظام الوقف من المصادر التاريخية والفقهية، ويقارن ما جمعه ويدرسه ويفرض الفروض عليها أو يفندها بالجرح والتعديل، ثم يتجه إلى مصدر خصب من مصادر تاريخ نظام الأوقاف ممثلاً في وثائق الوقف المحفوظة في وزارة الأوقاف، ودار الوثائق القومية (مجموعة المحكمة الشرعية)، وفي بطريركية الاقباط الارثوذكس، وفي دار الكتب، وفي دير سانت كاترين. واعتمد الباحث أساساً على هذه الوثائق التي ترجع إلى العصر المملوكي، والتي تزيد في مجموعها عن ثمانمائة وثيقة.
وترجع أهمية وثائق الوقف إلى أنها تقدم للباحث في تاريخ مصر في العصور الوسطى من المعلومات ما لا يتوافر عادة في المصادر التاريخية المعروفة، كما أنها تقدم له أيضاً ما يفسر الكثير من الحوادث التاريخية. ورغم ذلك فأنى أرى أننا ما زلنا في بداية الطريق من أجل الإفادة من الوثائق كمصدر خصب للدراسة وإلقاء الضوء على جوانب متعددة من الحضارة الإسلامية في مصر في العصور الوسطى.
