لقد تناولت هذه الدراسة بحث إختصاص مجلس الأمن في طلب إرجاء إجراءات التحقيق أو المقاضاة أمام المحكمة الجنائية الدولية بموجب المادة (16) من نظامها الأساسي، وقد تبين أن الإختصاص المذكور يمكّن المجلس من الوقف المؤقت لإجراءات المحكمة لمدة (12) شهراً قابلة للتجديد إنطلاقاً من مهامه الأساسية المتمثلة بحفظ السلم والأمن الدوليين، وقد اتضح إمكانية المجلس من ممارسته لهذا الإختصاص دون تقيده بإرجاء الحالات التي يحيلها إلى المدعي العام للمحكمة فقط، بل يشمل أيضاً الإحالة من الدولة الطرف في النظام الاساسي لها، وكذلك عند الإحالة من الدول غير الأطراف بموجب الفقرة (3) من المادة (12) من ذات النظام، فضلاً عن حالة مباشرة المدعي العام التحقيق من تلقاء نفسه، ويمكن للمجلس أن يطلب من المحكمة عدم البدء أو المضي في إجراءاتها في أي مرحلة يشاء فيها إلى ما قبل إصدار الحكم.
وقد اتضح أيضاً أن الإختصاص المذكور يسهم في إفلات مرتكبي أشد الجرائم خطورةً من العقاب، إذ أنه يُفقد فاعلية مبدأ تكامل النظام الأساسي للمحكمة في ملاحقة المجرمين ومحاكمتهم عند عدم قدرة القضاء الوطني أو عدم رغبته في تحقيق ذلك، واتضح أن لذلك الإختصاص أثراً واضحاً في وقف تعاون الدول مع المحكمة، إذ تتحرر الدول من إلتزاماتها بالتعاون معها وتكون ملزمة بتنفيذ قرار المجلس بطلب الإرجاء إستناداً إلى المادة (103) من ميثاق منظمة الأمم المتحدة.
وأوضحت الدراسة أن طلب الإرجاء يمنع الضحايا من الحصول على حقهم في الإقتصاص من الجناة وكذلك حقهم في التعويض عن الأضرار التي لحقت بهم، فضلاً عن أنه يوقف محاكمة المتهم في فترة الإرجاء القابلة للتجديد لمرات غير محددة مما يجعل مصيره مُعلّقاً لمدة طويلة، وقد يكون مقبوضاً عليه، دون أن يبين النظام الأساسي مصيره، كما إنه لم يُنظّم مسألة حماية أدلة الإثبات في تلك الفترة، إذ لم يقم بتخويل أي جهة صلاحية إتخاذ الإجراءات الكفيلة بحفظها، الأمر الذي يجعلها عرضة للتلف أو السرقة.
واهتمت هذه الدراسة أيضاً، بعرض الممارسة العملية لإختصاص طلب الإرجاء وفقاً لقرارات المجلس المرقمة (1422) عام 2002 و(1487) عام 2003 بشأن الحالة في البوسنة والهرسك و (1497) عام 2003 بشأن الحالة في ليبيريا، و(1593) عام 2005 بشأن الحالة في السودان وكذلك (1970) عام 2011 بشأن الحالة في ليبيا، وقد تبين أن تلك القرارات جاءت مخالفة لشروط ممارسة الإختصاص المذكور نتيجة مخالفتها لنظام روما الأساسي وميثاق الأمم المتحدة فضلاً عن مخالفتها للقواعد الآمرة في القانون الدولي، الأمر الذي يجعلها قرارات غير مشروعة.
