عنوان كتابي هذا هو أحكام الضرر المحتمل والنفع المحتمل في الفقه الإجتماعي الإسلامي، وهو الجزء الثاني وكان الجزء الأول (أحكام الضرر الأدبي والمادي في الشريعة الإسلامية)، طبع في مركز البحوث والدراسات الإسلامية ديوان الوقف السني، سنة (2008)، وفي هذا الكتاب تطبيق تفصيلي (لأحكام الإلتزام بما لا نص فيه)، وقد أثبت الجميلي في نظرية الإلتزام بما لا نصّ فيه، أن الفقه الإسلامي الميمون لهو قادر على إستنباط الأحكام، لما تقتضيه مصالح الانام إلى يوم اللقاء مع العليم العلام بنظر المجتهدين المستقيمين إلى صفة الحكم الظاهر أو صفة ما يؤول إليه.
ولهذه القواعد الغرّاء تطبيقات شتى أشرنا إليها في سفرنا أحكام الضرر المادي والأدبي إذ استطعنا بحمد الله تعالى أن نثبت قدرة الشريعة الإسلامية على تفصيلاتها لأحكام الضرر الأدبي، مفنّدين نظريات المتفقهين، الذين نفوا إعتماد الفقه الإسلامي على تعويض الضرر الأدبي أو المعنوي، وقد فنّدنا تلك الآراء التي ما لبثت أن صارت غُثاءً تهاوت أمام حقيقة الفقه الزائد، هذا النظر المبين مردّه الإيمان المعتمد على اليقين.
