الطعن في الحكم هو الرخصة المقررة لأطراف الدعوى لاستظهار عيوب الحكم الصادر فيها، والمطالبة- لدى القضاء المختص- بإلغائه أو تعديله على النحو الذي يزيل عيوبه. وتستعمل هذه الرخصة في صورة طرق معينة حددها القانون ويطلق عليها تعبير "طرق الطعن في الأحكام". وهذه الطرق عبارة عن "مجموعة من الإجراءات تستهدف إعادة موضوع الدعوى على القضاء، أو تستهدف تقدير الحكم ذاته، وذلك ابتغاء إلغائه أو تعديله. وقد أورد الشارع طرق الطعن في الأحكام على سبيل الحصر وهي المعارضة والاستئناف والنقض وإعادة النظر. ومن ثم لا يمكن أن تناقش عيوب الحكم- مهما كانت واضحة- من غير هذه الطرق.
وسوف يقتصر بحثنا في هذا الكتاب على طرق الطعن العادية، فبعد دراسة المعارضة في (الفصل الأول) سوف نتناول الاستئناف في (الفصل الثاني).
