صدر اول قانون عقوبات - بمفهومه الحديث - في فرنسا سنة 1791 وكان متأثرا بأفكار العالم الإيطالي بيكاريا. ولذلك فقد حرص هذا القانون على تفادي مساؤى النظام الجنائي الذي كان سائدا قبل الثورة الفرنسية ، فتضمن مبدأ شرعية الجرائم والعقوبات وهو ما نصت عليه صراحة المادة الثامنة من إعلان حقوق الإنسان والمواطن الصادر سنة 1789 بل لقد تبنى نظام "العقوبات الثانبت" ومؤدي هذا النظام ان يحدد المشرع العقوبة المقررة للجريمة نوعا ومقدارا بحيث تكون ذات حد واحد وينحصر دور القاضي في مجرد التحقق من ارتكاب الجريمة، والنطق بالعقوبة المقررة لها قانونا إذا ثبت أن المتهم قد ارتكبها.
وفي هذا الكتاب نقدم تعليقا على قانون العقوبات الفرنسي الجديد الصادر سنة 1992 والمعمول به منذ اول مارس 1994م.
