يهدف هذا البحث إلى معالجة العديد من القضايا الفقهية المستجدة، والتي طرحت نفسها بقوة على ساحة النقاش الفقهي المعاصر، في مجال الأحوال الشخصية والسرة، ومحاولة التوصل إلى الحكم الشرعي المناسب لكل قضية منها، من خلال اتباع النمط المعرفي السليم حين بيان الحكم الشرعي، والذي يقوم على دراسة جادة لمختلف الأبعاد مما له علاقة بمحل الحكم، قبل بيان الحكم نفسه، ومن ثم توظيف الفكر النظري في معالجة العديد من الإشكالات الميدانية والواقعية في حياة الناس اليومية.
وقد استلزم كل هذا من الباحث أن يتبع المنهج الاستقرائي في محاول للإطلاع على ما كتب حول هذه القضايا من آراء وفتاوى، وابتاع ذلك بدراسة تحليلية لفهم نصوص الشارع، ومعرفة مقصده تجاه جزيئات كل قضية مطروحة مع محاولة أن يسبق ذلك إطلاله تاريخية لتتبع نشأة هذه القضايا والأسباب التي أدت إلى إثارتها في واقع المسلمين.
إن هذه الدراسة وإن خرجت بمجموعة من النتائج والتوصيات تجاه كل قضية منها إلا أنها في ذات الوقت تعد إحدى النماذج التي توصل لمدى اهتمام الفقه المعاصر في تكثيف الدراسات الميدانية والواقعية التي تعالج مثل هذه الإشكالات الاجتماعية، وعموماً فالدراسة في مجموعها تقدن للقارئ فرصة الاطلاع على الجهد الذي قدمه الفقه المعاصر تجاه القضايا المطروحة، وتقييم أدائه في مواجهة إشكالات الواقع اليومية.
