ومن الأمور الفقهية المعاصرة التي تحتاج إلى دراسة شرعية دقيقة موضوع الفحص الطبي قبل الزواج، فكان لا بد من بحث هذا الموضوع من كل جوانبه الشرعية وهل يمكن لولي الأمر أن يلزم الناس بهذا الفحص أو أن يفرض عليهم القيام بفحص أمراض بعينها دون أخرى أو يمنع القيام بهذه الفحوصات من باب السياسة الشرعية مع الإشارة إلى القوانين المتعلقة بهذا الموضوع في قانون الأحوال الشخصية الأردني المعمول به في المحاكم الفلسطينية وسوف يقوم الباحث بدراسة ميدانية بهذا الخصوص.
