نتيجة للتطور العلمي الذي شهده العصر الحديث، طورت الجريمة وظهرت نوعية من المجرمين الذين انتقلوا بالجريمة من صفتها التقليدية وأبعادها المحدودة إلى آفاق جديدة تعتمد على التقنية الحديثة، وتستخدمها في تنفيذ الفعل المجرم بأساليب مبتكرة وطرائق لم تكن معروفة في السابق.
وساعد على بروز هذه الجرائم ظهور تقنيات الاتصال ووسائل الحاسب الآلي، التي كونت من خلال اعتماد كل منهما على الآخر نظاماً جديداً هو النظام المعلوماتي الذي أصبح يستخدم في المجالات كافة، ليدخل في عمل الهيئات الحكومية التي تعتمد عليه بدرجة كبيرة، وبخاصة في الزمن الحالي، كما أن الاستخدام الفردي لهذا النظام أصبح جزءاً من الحياة اليومية للأفراد.
ومع أهمية التعامل بالأساليب التقنية الحديثة، مثل الحاسب الآلي، والإنترنت، والخدمة العظيمة التي يؤديانها، ووجود عنصري الخير والشر في تلك الأنشطة، ظهر الكثير من الأساليب الإجرامية المستحدثة التي تهدد مصالح الأفراد والمجتمع. وهذا فرض أهمية الحماية القانونية لمواجهة الأفعال الإجرامية المرتكبة بوساطة النظام المعلوماتي.
من هنا أصبحت حماية النظم المعلوماتية والمواقع والشبكات من أولويات الشركات الصانعة، وبالمقابل كثف مجرمو المعلوماتية مساعيهم لزيادة نشاطهم وعملياتهم، من خلال الشبكة العالمية التي تمكنهم من الدخول إلى أصعب المواقع وأكثرها حماية، برغم جهود الحماية التقنية المبذولة لمنع جرائمهم.
ومما يزيد انتشار هذه الجرائم تطور الوسائل المعلوماتية الحديثة التي تعاظمت فرص انتشارها، وقد لفت هذا أنظار الدول والهيئات العالمية إلى إدراك خطورة تلك الجرائم، ومدى سهولة ارتكابها، وتأثيرها المباشر في جميع المجالات، بما في ذلك تهديدها للأمن بمستوياته كافة، وهذا ما جعل مكافحتها من أولويات المجتمع والحكومات.
ولعل أبرز العوائق القانونية التي واجهت القانونيين المهتمين بدراسة الجرائم المعلوماتية، مدى إمكانية تطبيق القوانين التقليدية على هذه الجرائم وتكييف الأفعال المكونة لها، لتدخل في نطاق النصوص التي تعالج الجرائم التقليدية، وهذا ما أوجد عدداً من الاتجاهات القانونية التي تنادي بسن قوانين خاصة لمواجهة هذه الجرائم.
في هذا الإطار تأتي الدراسة التي بين يدينا والتي تتحدث عن مكافحة الجرائم المعلوماتية وتطبيقاتها في دول مجلس التعاون لدول الخليج العربية.
