تلجأ الإدارة - في ممارسة نشاطها - إلى أساليب متنوعة، منها أساليب القانون الخاص (كالعقود المدنية) وأساليب القانون العام بما تمنحه من امتيازات وبما تحملها من تكاليف والتزامات وقيود غير مألوفة في علاقات القانون الخاص، وذلك بهدف تحقيق الصالح العام، وهذه الأساليب قد تأخذ صورة قرارات إدارية تصدر من جانب واحد، وقد تكون صادرة من جانبين كالعقود الإدارية، وإلى جانب هذه التصرفات القانونية من قرارات وعقود - فإن الإدارة تأتي كثيرًا من الأعمال المادية.
فالعقود الإدارية تتفق مع العقود المدنية في كونها تنشأ من توافق إرادتين: إرادة الجهة الإدارية وإرادة المتعاقد معها، ويظهر فيها مجال معين لتطبيق مبدأ "العقد شريعة المتعاقدين" ولكن الإدارة تتمتع في العقود الإدارية بامتيازات وحقوق في تعديل شروط العقد، وفي الإشراف على تنفيذه وتوجيه المتعاقد معها، وفي توقيع الجزاءات، وفي إنهاء العقد بإرادتها المنفردة، خروجًا على مبدأ أن العقد شريعة المتعاقدين، تحقيقًا للصالح العام وما تمليه مقتضيات حسن سير المرافق العامة بانتظام واطراد، وتخضع الإدارة من ناحية أخرى لقيود في اختيار المتعاقد معها وفي إبرام العقد الإداري، وهي قيود لا يخضع لها الأفراد في عقودهم الخاصة.
