في مصر لم تظهر فكرة العقود الادارية بوضوح إلا بعد أنشاء مجلس الدولة المصري 1946 رغم أن قانون المجلس لم يكن يتضمن اى إشارة لاختصاصه في مجال العقود الإدارية، وحين صدر القانون الثالث للمجلس 165 لسنة 1955 تغير الوضع وأصبح المجلس يختص بمنازعات كل العقود الإدارية فقد نصت المادة العاشرة منه على أن: " يفصل مجلس الدولة بهيئة قضاء إداري دون غيره في المنازعات الخاصة بعقد التزام عقد التوريد وعقد الأشال العامة أو أى عقد أداري أخر واستمرت هذه الصياغة في ظل القانون 55 لسنة 1959 والقانون الحالي 47/1972 كما سنوضح تفصيلا فيما بعد. سنتقسم هذا المؤلف إلى بابين: الباب الأول: - تتناول فيه الأسس العامة للعقود الإدارية سواء من الناحتين النظرية أو التطبيقية في التشريعات المقارنة. - نخصصه لدراسة العقود الإدارية في مصر وفقا للقوانين واللوائح الصادرة حتى مثول المؤلف للطبع.
