الحق فى التنازل عن الشكوي -كوجه مقابل للحق فى تقديمها- يمثل أهمية قصوى فى الإجراءات الجنائية فعن طريقه أعطى المشرع للمجنى عليه فرصة للعدول عن شكواه, إذا قدر أثناء السير فى الدعوي أن من المصلحة تفادى النتائج التى تترتب على صدور حكم نهائى فيها, هذه النتائج التى تمس صالحه الخاص أو صالح أسرته, أكثر مما تمس صالح المجتمع. كما أن الحق فى التنازل يبرز دور المجنى عليه فى إنهاء الدعوي الجنائية بإرادته المنفردة, وهذا ما يتفق مع السياسة الجنائية الحديثة. وأخيراً يساعد هذا الحق على الاقتصاد فى الإجراءات والتخفيف عن كاهل القضاء, مما يكفل حسن إدارة العدالة الجنائية.
ولعل ذلك هو ما دفعنا إلى تأصيل التنازل عن الشكوي وتحديد ملامحه الرئيسية وحدوده القانونية.
وسوف نقسم هذا البحث إلى عدة فصول:
الفصل الأول: ماهية التنازل عن الشكوى وطبيعته القانونية.
الفصل الثانى: صاحب الحق فى التنازل عن الشكوى.
الفصل الثالث: الجرائم محل التنازل عن الشكوى.
الفصل الرابع: شكل التنازل عن الشكوي.
الفصل الخامس: وقت صدور التنازل عن الشكوى.
الفصل السادس: الآثار الإجرائية للتنازل عن الشكوى.
ثم نتبع ذلك كله بخاتمة تبين نتائج البحث وما نراه من مقترحات.
