يضم هذا المؤلف دفتيه على دراسة تحليلية للقاعدة الجنائية، على ضوء الفقه الجنائي المعاصر، العربي منه والمقارن، وبالنظر إلى جانب من التشريعات العربية الراهنة وهي قانون العقوبات المصري ومشروعه الذي أعد أخيراً ليحل محله وقانون العقوبات السوري واللبناني والأردني والعراقي. ولقد قادتنا دراستنا هذه إلى طرق العديد من الجوانب النظرية التي تزخر بها خزانة الفقه المقارن ولا سيما في كل من المانيا وإيطاليا، وحدتنا إلى التصدي للكثير من التفصيلات الممتعة في الدقة والمسترسلة مع الإسهاب والغرقى فى خضم الجدل الفقهي، الأمر الذي يخشى معه أن يظن بعض القراء للوهلة الأولى من قراءتهم لها أننا بها قد أسلمناهم للترف الفكري والتجريد النظري، وأن كنا على ثقة من أن مثل هذه الخشية لن تلبث أن يبددها اعتقادنا في أنه على قدر ما يغوص بنا التحليل والتأصيل النظريان يتوقف بسوق سياسة التجريم والعقاب وسموق التطبيقات العملية للقواعد الجنائية داخل النظام القانوني الذي يستهدف الصالح العام.
موضوع هذه الدراسة اذن هو القاعدة الجنائية، وهذه تتوثق بعرى لا انفصام لها مع التشريع الجنائي، فضلا عن وثيق علاقتها بالقانون الجنائي.
