اهتم الإسلام ببيان وسائل الإثبات حتى لا تضيع الحقوق واعتبر الإسلام شهادة الشهود أهم وسيلة لإثبات الحقوق على اختلاف أنواعها ولهذا توسع الفقهاء المسلمون فى دارسة هذا الموضوع واولوه ما يستحق من العناية والاهتمام ولكن فى بحثلى هذا سوف اقتصر على بيان مدى حجية الشهادة ةالقرائن وهل هى كشهادة أم لا فى أثبات الحقوق فى الشريعة والقانون وهذا يقتضى منى أولاً أن اقف على ما هية الشهادة.
كما أن حجية الشهادة تتطلب شروطاً خاصة فى الشاهد الذى تقبل شهادته وحتى تأتى ثمارها فى الأثبات فالمحور الأساسى لبحثى هذا يدور حول الإجابة عن سؤال واحد وهو ما مدى حجية الشهادة والقرائن فى الشريعة والقانون؟ وما تناولته بخلاف ذلك من لوازم البحث فكان من البديهى أن أتعرض لتعريف الشهادة ثم شروطها ثم بعد ذلك حجتها وهذا فى الفصل الأول.
ثم تأتى بعد ذلك الفصل الثانى وأتناول فيه الحديث عن تعريف القرائن وأقسامها ومدى حجتها فى الشريعة الإسلامية والقانون الوضعى.
