يعد إستفتاء تقرير المصير من أهم صور الإستفتاء السياسي، الذي يجري لتخيير شعب من الشعوب، بين الإستقلال، أو التبعية لدول من الدول، أو الإتحاد معها.
ولهذا أصدرت الجمعية العامة ومجلس الأمن، مجموعة من القرارات التي تؤكد على أن إرادة الشعوب المستعمرة يجب التعبير عنها بطريق الإستفتاء، أو بغيره من الوسائل الديمقراطية.
إلا أن إجراء إستفتاء تقرير المصير، يحتاج إلى إطار قانوني لممارسته، أي لا بد من تنظيم الجوانب الإجرائية والموضوعية، من خلال الأبعاد الدولية والداخلية لهذه الآلية، وهذا يتطلب منا البحث في مشروعية إجراء إستفتاء تقرير المصير، وفقاً لقواعد القانونين الدولي والدستوري.
وتعد وسيلة / آلية الإستفتاء أفضل وسيلة للتأكد على إرادة الشعوب، وبعد إنهيار الإتحاد السوفيتي في عام 1991، وفتح الباب على مصراعيه لإجراء إستفتاءات الإستقلال، وفي كثير من الحالات أجريت الإستفتاءات، لأن المجتمع الدولي أصر على إجراء الإستفتاء من أجلٍ الإعتراف بالدولة الجديدة، وهناك أدلة تأريخية تشير إلى أن هذا الشرط هو الدفع عدداً كبيراً من الدول لإجراء الإستفتاء خصوصاً في يوغسلافيا السابقة.
إن هذا الكتاب يعالج هذه القضايا بصورة تحليلية مقارنة.
