منذ أكثر من عشر سنوات قدمنا الطبعة الأولى من الجزء الثالث من كتيب الإرشادات القضائية الذى نظرة من أحكام قانون الاجراءات الجنائية واقتصرنا من هذه الطبعة على أهم الأحكام التى تعرض للقاضى فى العمل لتنير له الطريق وتوفر عليه بعض الجهد المطلوب منه لمعرفه صحيح القانون.
ولما كان قد مضى على هذه الطبعة العديد من السنوات تعرضت فيها نصوص قانون الإجراءات للتعديل والتبديل. إذا استحدث المشرع أحكاماً جديدة لأنقضاء الدعوى الجنائية, بآن أضاف بالقانون رقم 174 لسنة 1998 المادة (18) مكرر إجراءات والتى بموجبها أجاز التصالح فى مواد المخالفات, وكذلك فى مواد الجنح التى يعاقب فيها بالغرامة, أو جوازياً بالحبس الذى يزيد حده الأقصى على ستة أشهر. ثم توسع المشرع فى نظام الصلح بأن نص فى العديد من القوانين التى أصدرها على إجازة التصالح فى الجرائم المعاقب عليها بمقتضى هذه القوانين. ونظراً لكثرة هذه القوانين وتنوعها فقد حاولنا بقدر الإمكان تجميع شتات هذه القوانين لبيان الجرائم التى يجوز فيها الصلح, وشروط صحة التصالح و آثاره فى انقضاء الدعوى الجنائية. ولما كان قد صدر خلال هذه الفترة العديد من المبادىء القضائية المستحدثة التى أرستها محكمة النقض, فقد زودنا هذه الطبعة بما استجد من المبادىء التى قررتها محكمة النقض بعد صدور الطبعة الأولى. وبعد فإنى أدفع إلى الميدان بهذا الجهد المتواضع. وآمل أن ينال هذه العمل المتواضع رضا الزملاء.
