لعل دراسة أحكام الأسرة بالشرائع غير الإسلامية أمر ليس باليسير لتعدد تلك الشرائع من جهة وتنوع مصادرها وعدم صياغتها في نصوص قانونية منهجية من جهة أخرى. إلا أن حيوية المادة وأهميتها العملية قد جذبت الفقه إليها ليتناولها بالتحليل والبحث، هذا بالإضافة إلى الرسيد القضائي الذي لا يستهان به في هذا المجال، فقد توصل القضاء بعد عناء إلى وضع الكثير من الحلول والمبادئ في هذا الصدد. لذا كان منهجنا مستنيرًا بحلول القضاء من جهة وبالمجهودات الفقهية السابقة من جهة أخرى.
ومن هذا المنطلق نستهل دراستنا بباب تمهيدي نعرض فيه لمجال تطبيق تلك الشرائع ومصادرها ومدى ولاية الشريعة الإسلامية. ثم نقسم الدراسة إلى ثلاثة أبواب للتعرف على النظام القانوني للأسرة في الشرائع غير الإسلامية، فالأسرة ترتبط بالزواج، فهي تنشأ بانعقاده وتبدو علاقاتها من خلال ما يترتب عليه من آثار، ويمكن أن تنتهي الأسرة كذلك بانتهاء الرابطة الزوجية.
