Book Description
ثقة الأفراد في البنوك هي الوعاء الأساسي الذي تنطلق منه عمليات التمويل النقدي للمشروعات المختلفة، تلك الثقة التي ظلت مفقودة لحقبة غير قصيرة من تاريخ مصر المعاصر.
لهذا قد صدر القانون رقم 205 لسنة 1990 في شأن سرية الحسابات البنكية. وقد اشتمل هذا القانون على تسع مواد، أخذت بمبدأ السرية للحسابات البنكية، وبينت الحالات الاستثنائية التي يتم فيها الخروج على هذا المبدأ. وإدراكاً من المشرع المصري لأهمية المصلحة التي أريد حمايتها بنصوص هذا القانون أظلها بالمظلة الجنائية، فقرر جزاء جنائيا خاصا لمن يخالف هذه النصوص.
إلا أن صدور هذا القانون ما كان ليمر دون أن نتساءل عن الجدوى منه، خصوصا مع وجود نص عام في قانون العقوبات يعاقب على إفشاء سر المهنة: فهل يشمل هذا النص العام بالحماية سرية الحسابات البنكية؟ وإذا كان الأمر كذلك، فما الذي أضافة القانون الجديد في هذا الخصوص؟ وللأجابة على هذين التساؤلين، يقودنا المنطق إلى دراسة سرية الحسابات البنكية في ضوء المادة 310 من قانون العقوبات التي تعاقب على إفشاء سر المهنة قبل أن نبين الوضع في ظل القانون رقم 205 لسنة 1990.
