إن البعد الإنساني، سواء في مجاله النفسي أو الاجتماعي، لا يزال يعمل عمله في ذهن الفقيه، ويؤثر عليه في إنتاجه لخطابه، وفي نظرته وموازنته للأحكام، وفي ترجيحه واختياره. فلم يكن الفقيه متعالياً عن استحضار هذا البعد.
إن هذا البحث يحاول أن يعيد الصلة بين العلوم الإنسانية والفقه الإسلامي، ويقدمها من خلال نموذج مختصر وهو (ولاية الفتاة البكر العاقلة).
هذه الدراسة تكشف عن أثر استحضار البعد النفسي والاجتماعي في إنتاج الفقيه لحكمه، من خلال واحدة من القضايا الجدلية القديمة/ الجديدة.
هل كان الفقهاء وهم يبحثون في هذه القضية يستحضرون بعدها النفسي والاجتماعي؟
وما هي الأبعاد التي استحضروها في ذلك؟
وهل تأثر الفقيه بمجتمعه في نظره لهذه المسألة؟
كل هذه التساؤلات يفتحها هذا البحث، ليلفت الأنظار إلى مسلك جديد من مسالك النظر في التحليل الفقهي لابد من استحضاره وتفعيله، وليمهد الطريق لدراسات أخرى مماثلة تجلي الأبعاد الأخرى التي ترتسم في ذهنية الفقيه وهو يعالج قضاياه الفقهية.
