يطرح هذا الكتاب تساؤلات كثيرة بشأن نظرة الإسلام إلى قضية اللاجئين، لاسيما أن نسبة كبيرة منهم حول العالم هم من الدول الإسلامية، أو يقيمون في هذه الدول، ومع ذلك، فإن نسبة قليلة من هذه الدول وقّعت على المعاهدات الدولية المتعلقة باللاجئين. فهل اللجوء يتعارض مع المفاهيم الإسلامية؟ وما المبادئ الإسلامية المتعلقة باللجوء؟ وما الحقوق والواجبات المترتبة على الدولة الإسلامية المتعلقة باللجوء؟ وما الحقوق والواجبات المترتبة على الدولة الإسلامية تجاه اللاجئين؛ وما درجة التقارب والاختلاف بين مفهوم اللجوء في الإسلام وبين معاهدة جنيف للاجئين لعام 1951؟
وكان التحدي في هذا الكتاب هو أن التراث الإسلامي لم يشمل باباً واضحاً تحت اسم اللجوء أو اللاجئين؛ فعمد إلى الغوص في مصادر التراث الإسلامي المختلفة ليحدد مرتكزات ما يعتبره نظام اللجوء في الإسلام، ثم اجتهد في مقارنة هذا النظام بمعاهدة جنيف الدولية المتعلقة بوضع اللاجئين لعام 1951؟ فدرسها بنداً بنداً لمعرفة مدى التقارب والاختلاف بين النظامين. وإذا لم تكن ثمة نصوص مفصّلة وواضحة في التراث الإسلامي تقابل مواد المعاهدة.
بحث الكتاب في هذه الحالات عن المبادئ والقيم في التراث الإسلامي التي تلتقي أو تختلف مع بنود المعاهدة. وخلص بعد دراسة كل بند إلى النظر إليه من الزاوية الإسلامية سواء بالاتفاق أو الاختلاف. ثم بعد هذا التأسيس استعرض الكتاب القوانين في الدول العربية التي تعالج موضوع اللجوء ليرى إن كانت هذه القوانين، إن وُجدت، تتفق أو تختلف مع النظام الإسلامي للجوء والقانون الدولي بهذا الخصوص
