يتمثل الهدف من هذه الدراسة فى تأكيد وتوضيح أن الشريعة الإسلامية قد سبقت بعدة قرون غيرها من القوانين الوضعية فى مجال المعاهدات والتركيز على تنظيم الشريعة الإسلامية للمعاهدات وإبراز المجالات التى تميز بها القانون الدولى الإسلامى بالسبق إلى وضع القواعد والمبادئ والأحكام العامة للمعاهدات وانها تتفق مع الأهداف والمبادئ النبيلة التى وضعها رواد القانون الدولى المتجردين من المصالح والغير مقيدين بمصالح أنانية لبلدانهم أو جنسياتهم.
ولا أزعم أن هذه الدراسة هى السباقة والوحيدة فى هذا المجال وأنما هى محاولة نضمها إلى الجهود القليلة المبذولة حتى الأن فى هذا الجانب، ومن هنا تكتسب الكتابة فى هذا الموضوع أهميتها، فالدراسات الإسلامية قليلة فى هذا الجانب مقابل ما كتب فى القانون الدولى الوضعى، ويزيد من اهمية الدراسة الإيمان بإمكانية إثراء القانون الدولى عن طريق التوسع فى الأسس التى وضعها الفقهاء المسلمين الأوائل أمثال: الإمام الشيبانى، الإمام السرخسى، والإمام الشيرازى والإمام العينى وغيرهم من رواد القانون الدولى الإسلامى.
ونظراً لأن التطبيق يفترض وجود القاعدة أولاً، لذلك ستركز الدراسة على الجانب النظرى للمعاهدات ، أكثر من جانبها التطبيقى.
وقد اقتضت الدراسة تقسيمها إلى فصل تمهيدي: تعريف المعاهدات والباعث على عقدها، وثلاثة فصول هى:- الفصل الأول: مشروعية المعاهدات وأنواعها وطبيعتها الدينية، الفصل الثانى: أثر المعاهدات بعد إبرامها، الفصل الثالث: نقص المعاهدات الدولية وإبطالها فى الإسلام.
