تهدف هذه الدراسة إلى تقديم رؤية فقهية قانونية للعلاقات الدبلوماسية تستند إلى القواعد الأصولية الكلية الإسلامية وقواعد القانون الدولي العام وإبراز دور أئمة الفقه الإسلامي في تكوين الدبلوماسية المعاصرة، وتتبع بشكل دقيق تطور هذه الدبلوماسية والمؤثرات التي ساهمت في بلورتها في الفكر السياسي الإسلامي، وقد حاول الباحث تأصيل أدوات وآليات الوظيفة الدبلوماسية ومقارنتها بأحكام الفقه الإسلامي والقانون الدبلوماسي المعاصر بغرض تسهيل وفهم قضايا الدبلوماسية من الناحيتين الفقهية والقانونية، لتعزز من انتماء الدبلوماسي المسلم لدينه وتراثه، مع مواكبة روح العصر.
وقد انتهجت الدراسة منهجاً تاريخياً تحليلياً، حيث تبدأ بعرض الرأي الفقهي للمسألة-قد البحث-مع الاسترداد التاريخي لها، والمقارنة بينها وبين الرأي القانون في تلك القضايا ثم تحليل ومناقشة أدلة الرأى الفقهي والقانوني.
وقد توصل الباحث في نهاية المطاف إلى عدة نتائج منها، أن الفقه عرف مفهوم الدبلوماسية وسبق التشريعات الدولية المعاصرة في كثير من الأحكام المرتبطة بها، وإن أحكام النظرية الدبلوماسية الحديثة المتجسدة في اتفاقية فيينا للعلاقات الدبلوماسية لعام 1961م أخذت من ممارسات الدولة الإسلامية مبادئ خلاقة كثيرة، وأهمها: السلوك الاجتماعي ومراسم الاستقبال وحصانة السفراء وممارستهم لحرياتهم، وحرمة المباني الدبلوماسية والصفات المعتبرة للسفراء وممارستهم لحرياتهم، وحرمة المباني الدبلوماسية والصفات المعتبرة للسفراء، وطرق إرسال الممثلين السياسيين واللغة الدبلوماسية الإسلامية الواضحة في تعاملها الصادقة في لهجتها.
