تقتضي قاعدة (نصل أوكام) Occam's razor- ، التي ولدت في أحضان المنهج التحليلي، الفرز بين العناصر الضرورية والعناصر غير الضرورية، وإجتثاث الأخيرة والتركيز على الأولى في التحليل وصولاً إلى الحقيقة.
وهذه القاعدة نادي بها الفيلسوف الإنجليزي (وليم الأوكامي)، ولهذا فهي منسوبة إليه، أما عن لفظة (نصل)، فمصطلح استخدمه هذا الفيلسوف للتعبير والتمثيل على حالة (القصَاب) الذي يستخدم نصله في الفصل بين العناصر النافعة وغير النافعة، وقد اعتمد على هذه القاعدة الفيلسوف المعروف (برتراند رسل) كإحدى طرق تحليل لديه.
وهذه القاعدة يجب الإستفادة منها في نطاق الدراسات القانونية، بعدما اختطلت بها تخصصات أخرى، كان من شأن هذا الإختلاط التأثير سلباً على المملكة القانونية لدارس القانون.
كما أن مصطلح الملكة القانونية هو مصطلح غامض في نطاق هذه الدراسات، إذ يقتضي البحث تعريفه والإحاطة بمضمونه؛ وقد ركّز البحث على الدور الذي تلعبه قاعدة (نصل أوكام) في تكوين ملكة قانونية سليمة، ومن خلاله وجدنا أن الأخذ بمنطق هذه القاعدة يؤدي إلى حل العديد من المشكلات القانونية، سواءً من الناحية النظرية أم من الناحية العلمية.
