يلعب التحكيم دوراً هاماً فى التجارة الدولية فى وقتنا الحاضر، ففى الكثير من العقود الداخلة فى نطاق التجارة الدولية، توجد ثمة نصوص عقدية تفيد أنه حال نشأة أى نزاع حول نص عقدى معين، فإن هذا النزاع سوف يتم حله عن طريق التحكيم.
فمن الواجب إجراء ثمة تفرقة بين التحكيم الوطنى والتحكيم الدولى، هذا بالرغم من أن بعض الدول إنما ينظم التحكيم الداخلى والدولى فيها داخل تقنين واحد، ولكن مثل هذا الوضع لم يمنع المشرعين من التمييز بين التحكيم الداخلى والتحكيم الدولى داخل التقنين المعنى، فعلى سبيل المثال، فالمشرع الفرنسى يميز التحكيم الدولى عن التحكيم الداخلى، وينظم النوع الأول بقواعد معينة، فى حين أنه ينظم النوع الثانى بطائفة أخرى من القواعد، بما يفيد أن كل نوع من أنواع التحكيم المتقدمة، له قواعده وأحكامه الخاصة، والتى لا تصلح للانطباق على النوع الآخر. وعلى هذا سوف تنقسم الدراسة إلى فصل تمهيدى من ثلاثة مباحث الأول مناط وطنية التحكيم التجارى، الثانى مناط أجنبية التحكيم التجارى والثالث نشأة التحكيم التجارى الدولى، وبابين الأول فى معيار دولية التحكيم التجارى بين الفقه والقضاء والباب الثانى فى معيار دولية التحكيم التجارى والاتفاقات الدولية والتشريعات الوطنية.
