تكمن أهمية البحث في موضوع: " حق الأجانب في التملك في القانون الدولي الخاص اليمني والمصري دراسة مقارنة" في أن هذا الحق يرتبط بطبيعة الإنسان ذاه، وما جبل عليه من حب للمال ورغبة في التملك وبالرغم من أهميته تلك إلا أنه لم يحظ بالدراسة الكافية والوافية سواء اكان على مستوى الفقه القانوني ام كان ذلك على مستوى الفقه الإسلامي الحديث. ويضاف إلى تلك الأهمية السابقة أن النصوص المنظمة لهذا الحق في الحق في القانون اليمني لم تنلها أية دراسات فقهية منذ صدور القوانين التى تضمنت تلك النصوص حتى الان. وقد أمل الباحث من دراسة هذا الموضوع في كل من القانون اليمني والمصري وبعض القوانين العربية والأجنبية والفقه الإسلامي أن يسهم في شرح وتحليل تلك النصوص في القانون اليمني كون هذا الموضوع يعد بكرا في هذا القانون
