في تقديرنا أن فكرة الطرف الضعيف في الرابطة العقدية شهدت قدراً كبيراً من التطور. ففي بادئ الأمر، جرى التعبير عن هذه الفكرة في إطار مفهوم ضيق صاغته نظرية عقود الإذعان. ثم شهد هذا المفهوم اتساعاً كبيراً على أثر تفشي ظاهرة الاستهلاك، وتحول فكرة المستهلك من فكرة اقتصادية في الأصل إلى فكرة قانونية تدور حولها طائفة تضم عقوداً متنوعة تعرف بعقود الاستهلاك.
فهذه العقود تقوم على اعتبار المستهلك طرفاً ضعيفاً في الرابطة العقدية بناء على مفهوم واسع لفكرة العاقد الضعيف ولكنه يشكل، في نطاق كبير، امتداداً لذات المفهوم الذي صاغته عقود الإذعان، الأمر الذي يدعونا إلى دراسة مفهوم هذا الطرف في هاتين الطائفتين في سياق واحد.
وعلى العكس من ذلك، تأتي فكرة الطرف الضعيف في المعاملات التجارية لتحمل مفهوماً مختلفاً، بحيث لا يمكن اعتباره امتداداً لمعناها سواء في إطار عقود الإذعان أو عقود الاستهلاك.
وعلى ضوء ما تقدم نتناول دراسة فكرة الطرف الضعيف في العقود في ثلاثة مباحث: نتحدث في أولها عن فكرة الطرف الضعيف في الرابطة العقدية بوجه عام. ونخصص الثاني لبحث المفهوم التقليدي لهذه الفكرة، سواء بمعناها الضيق في نطاق عقود الإذعان، أو بمعناها الواسع في إطار عقود الاستهلاك. ونعرض في المبحث الأخير لتحديد مضمون هذه الفكرة في مجال المعاملات التجارية: المبحث الأول: فكرة الطرف الضعيف في الرابطة العقدية بوجه عام، المبحث الثاني: التطبيقات الخاصة لفكرة الطرف الضعيف، المبحث الثالث: مفهوم الطرف الضعيف في المعاملات التجارية.
