تنص المادة 5 من الإعلان العالمي لحقوق الإنسان على أنه "لا يجوز إخضاع أحد للتعذيب ولا للمعاملة أو العقوبة القاسية أو اللاإنسانية أو الحاطو بالكرامة، كما تنص المادة 7 من العهد الدولي الخاص بالحقوق المدنية والسياسية على أنه لا يجوز إخضاع أحد للتعذيب ولا للمعاملة أو العقوبة القاسية أو اللاإنسانية أو الحاطة بالكرامة، وعلى وجه الخصوص، لا يجوز إجراء أية تجربة طبية أو علمية على أحد دون رضاه الحر، وإنفاذاً لهذه المبادئ تم عقد إتفاقية مناهضة التعذيب، ونظراً، لأغراض هذا البحث نقصر الدراسة على نصوص إتفاقية مناهضة التعذيب مع اللجوء لنصوص الاتفاقيات والعهود الأخرى بالقدر اللازم لتوضيح وجهة نظرنا؛ وذلك من خلال خطة البحث التالية والتي ألحقنا بها عدد من المواثيق والنصوص المرتبطة بها، الفصل الأول: تعريف التعذيب وضروب المعاملة القاسية، الفصل الثاني: آليات مناهضة التعذيب، الفصل الثالث: دور النيابة العامة في تطبيق اتفاقية مناهضة التعذيب.
