لفت نظري بعض أساتذتي وأصدقائي لحاجة المكتبة القانونية المصرية لبحث موضوع توظيف الأموال أو شركات تلقي الأموال كما سماها القانون رقم 146 لسنة 1988 خاصة الجانب الجنائي منه، ولعل مرجع هذا الأمر هو أن قانون الشركات العاملة في مجل تلقي الأموال لإستثمارها إذا ما حاولنا تصنيفه ضمن فروع القانون لوجدناه أحد قوانين فرع القانون التجاري، ولكن ما تضمنه هذا القانون من نصوص تجريم قررت عقوبة الجناية لبعض مخالفته أمر يجعل هذا القانون أحد القوانين المكملة لقانون العقوبات، وهو ما يدفعنا لمحاولة فهم نصوص القانون من الناحية الجنائية وذلك من خلال تحليلها وتطبيق القواعد العامة عليها وصولاً لتحديد جرائم توظيف الأموال، ولما كان القانون رقم 146 لسنة 1988 يتضمن شقين كما اسلفنا شق تجاري وشق جنائي وكان بحثنا هذا يتناول الشق الجنائي بصفة أساسية لما له من أهمية في التطبيق العملي فقد قسمنا خطة الكتاب على النحو التالي:ـ الفصل الأول: جرائم توظيف الأموال، الفصل الثاني: العقوبات، الفصل الثالث: انقضاء الدعوى الجنائية والإعفاء من العقوبة، الفصل الرابع: نتناول فيه إجراءات التحقيق والمحاكمة، مأموري الضبط القضائي، النيابة المختصة، الإدعاء المدني، التحفظ على الأموال، الفصل الخامس: الدفوع المثارة أمام محكمة الجنايات، الفصل السادس: المحكمة المختصة "المحاكم الإقتصادية".
