يعتبر الزنا في الشريعة الإسلامية كل صلة جنسية محرمة بين رجل وامرأة- فلا يشترط أن يكون أحدهما أو كلاهما متزوجًا، إذ الزواج ليس ركنًا في الجريمة- شأن القانون- وإنما هو ظرف مشدد فقط للعقاب.
وبالمقارنة بين التعريف الوضعي والتعريف الشرعي لجريمة الزنا يتبين من أول وهلة أن معناه في الشريعة أعم منه في القوانين الوضعية فيعتبر في نظرها زانيًا كل من يجتمع على فاحشة سواء كان محصنًا أو غير محصن- فهو يشمل الزنا المصطلح علي تسميته كذلك في القانون الوضعي ويشمل الوطء على غير المتزوجة.
وفي هذا الكتاب سوف نعرض لجريمة الزنا في القانون المصري والشريعة الإسلامية في أربع الفصل الأول وفيه نتناول زنا الزوجة في ثلاثة مباحث: (أركان الجريمة، تحريك الدعوى، شريك الزوجة الزانية)، الفصل الثاني وفيه نتناول زنا الزوج في ثلاثة مباحث: (أركان الجريمة، تحريك الدعوى، شريكة الزوج الزاني)، الفصل الثالث وفيه نتناول أدلة الزنا في القانون المصري والشريعة الإسلامية وذلك في مبحثين: (أدلة الإثبات العامة في الزنا، أدلة الإثبات بالنسبة لشريك الزوجة الزانية)، الفصل الرابع نتناول عقوبة الزنا في مبحثين: (عقوبة الزنا في القانون المصري، عقوبة الزنا في الشريعة الإسلامية).
