احتوت هذه الرسالة على مقدمة وأربعة فصول وخاتمة تحدثت فيها عن أهمية دراسة الفقه الإسلامي، واهتمام علماء المسلمين به، ووجوب العمل بأحكامه، كما تناولت أهمية الكتابة في موضوع الرسالة وأهدافها وأهم ما كتب في موضوعها ومنهج البحث وخطته.
فقد بحثت في الفصل الأول ثلاثة موضوعات تشمل ثلاثة مباحث، كان أولاها في تعريف الزنى لغة وشرعاً، وقد عرفت الزنى بأنه اتصال جنسي غير مشروع بوجه من الوجوه يفضي إلى قضاء الشهوة، وبعد شرح التعريف تفرع عنه عدة مسائل لها علاقة به كوطء الميتة، وإتيان البهيمة، واللواط، ووطء الصغيرة، ووطء الصغير والمجنون بالغة عاقلة، ووطء المكرَه والمكرهة على الزنى والسحاق، وجميعها محرمة شرعاً ومتفق على تحريمها، إلّا أن الفقهاء اختلفوا في إيجاب بعضها للحد، وعدم إيجابها، كما أن بعضها يعتبر زنى شرعاً بخلاف البعض الآخر فمثلاً وطء الميتة زنى بالمعنى الشرعي إلا أنه غير موجب للحد، وإتيان البهيمة ليس زنى وغير موجب للحد.
أما المبحث الثاني فكان في حكم الزنى؛ والزنى حرام شرعاً، ثبت تحريمه بالكتاب والسنة والإجماع والمعقول، ولتحريمه حِكَم كثيرة ذكرتها في هذا البحث منها المحافظة على المجتمع من الوقوع في المفاسد، وحفظ النسل والنسب، ومنع انتشار الجريمة، إضافة إلى تأثيره على مرتكبه من الناحية الروحية والجسدية وغيرها.
وآخر أبحاث هذا الفصل فكان في عقوبة الزاني المحصن، وعقوبة الزاني غير المحصن؛ أم عقوبة الزانية المحصن فهي الرجم باتفاق الفقهاء، وفي وجوب الجلد معه خلاف الراجح عدم وجوبه. وأمنا عقوبة الزانية غير المحصن فهي الجلد مائة جلدة باتفاق الفقهاء، واختلفوا في وجوب التغريب مع الجلد، والراجح وجوبه على الذكر دون الأنثى.
