الأصل أن النيابة العامة هى المختصة بتحريك الدعوي الجنائية ولكن القانون قيد سلطتها فى بعض الأحيان فلا يجوز لها أن تحرك الدعوي الجنائية على الرغم من توافر أركان الجريمة وتتمثل القيود القانونية التى تغل يد النيابة العامة فى الشكوي أو الطلب أو الأذن وتناولنا فى هذا الكتاب موضوع الشكوي بداءة ممن لهم الحق فى تقديم الشكوى وشرح وافى للجرائم التى يتوقف تحريك الدعوى الجنائية بصددها على تقدم المجنى عليه بشكواه والشروط المتطلبة لصحة الشكوى والآثار المترتبة على تقديم الشكوي ورأينا من الضرورة العلمية أن نورد بصدد كل موضوع من هذه الموضوعات ما استقرت عليه أحكام النقض حتى عام 2004 وختمنا الكتاب بالتعليمات العامة للنيابات فى صدد الشكوى والطلب والإذن والبلاغ والإدعاء المباشر.
وقد جعلناه فى أربعة فصول هى دراسة عامة فى موضوع الشكوى, أحكام الشكوي, انقضاء الحق فى الشكوى والتعليمات العامة للنيابات.
