إن حماية حياة الإنسان وسلامة جسده من أساسيات القانون الوضعي كما أنها محور بإهتمام الشرائع الدينية وكذا الإتفاقات الدولية المعنية بحقوق الإنسان وقد برز دور القانون الجنائي في هذا المجال إذ أنه وفقاً لأحكامه فإن جسم الإنسان بأعضائه ووظائفه العضوية والحيوية وسواء أكانت الأعضاء الخارجية أم الأعضاء الداخلية مصون ويخضع للحماية القانونية.
أما القانون المدني فله وسائله وأدواته فحماية الإنسان بوصفه غاية التنظيم القانوني تعد من أساسيات القانون المدني وأولوياته الذي هو الآخر جسم الإنسان معصوماً من إعتداء الآخرين والحماية تمتد فتشمل كيانه المادي - جسده - وكيانه المعنوي.
لأهمية هذا الموضوع، جاء هذه الدراسة في الأضرار الواقعة على حياة الإنسان وسلامة جسده نتيجة التصرفات القانونية والوقائع المادية والسبل الكفيلة في تعويض هذه الأضرار ولا سيما وأن هناك معوقات تمنع المضرور من الحصول على حقه الكامل في التعويض وتتمثل هذه المعوقات بالمشكلات القانونية سواء تلك المتعلقة بإسناد المسؤولية وفي إطار القوانين الداخلية أو تلك المتعلقة بالمشاكل التي تصيب المضرور وتمنعه من المطالبة بحقه قضائياً وتتمثل بالمشاكل الواقعة عليه في ظل الحروب والإحتلال العسكري ليشمل بذلك الفترة الواقعة بين بداية الشخصية القانونية للإنسان ونهايتها.
وقد اقتضى البحث في هذا المجال له أهميته الخاصة، فهو بحث يقتضي التعرض لأحكام القانون المدني والقانون الجنائي، كما يقتضي التعرض لبعض القواعد الطبية، وقواعد الشريعة الإسلامية وكذلك التعرض للمواثيق والإتفاقيات الدولية والدساتير الوطنية، وهي مقارنة لا تخلو في ذاتها من فائدة.
