تفترض المسؤولية المدنية في صورتها التقليدية وجود مسؤول عن الضرر يلتزم بدفع التعويض تأسيساً على فكرة الخطأ، فمرتكب الخطأ هو من يلتزم بدفع التعويض، إلا أن هذه الفكرة لا تتناسب مطلقاً مع الضرر الجسدي، سيما إذا كان الضرر الجسدي ناتجاً عن سبب مجهول، أو إذا أثبت المدعى عليه أن هناك سبباً أجنبياً قطع رابطة السببية بين الخطأ والضرر. وإذا كانت وظيفة التعويض ــ كقاعدة عامة ــ هي إصلاح الضرر، وذلك بترضية المضرور، ومحاولة إعادته إلى الوضع الذي كان عليه قبل وقوع الضرر، فلا بد لكي يحقق التعويض هذه الوظيفة، أن يكون عادلاً بأن يغطي كل عناصر الضرر، وأن يكون سريعاً، إذ إن الضرر الجسدي ليس على درجة واحدة ولا على طبيعة واحدة بل هو متعدد العناصر. وبالتالي فإن أحكام المسؤولية التقليدية قد تكون عاجزة ــ في كثير من الأحيان ــ عن توفير الضمان الفاعل للمضرور جسدياً لحصوله على التعويض العادل، لذلك فقد أبرز الفقه الحديث في مجال تعويض المضرور جسدياً نظريتين هما(أولاً: نظرية تحمل التبعة ومضمون هذه النظرية هو أن المتسبب بالضرر هو من يتحمل عبء تعويضه، وذلك تأسيساً على أن الشخص يجب أن يتحمل مخاطر فعله وتصرفاته، بصرف النظر عما إذا كان الفعل الصادر منه ينطوي على خطأ أم لا، ويعد ذلك تطبيقاً لقاعدة الغرم بالغنم. ثانياً: نظرية الضمان وتستند هذه النظرية على أن لكل فرد في المجتمع الحق في الاستقرار، فإن وقع مساس بحقه في السلامة الجسدية بسبب ليس من قبله، كان ذلك ضرراً غير مشروع يستوجب التعويض، وعلى المجتمع أن يضمن تعويض الأضرار الجسدية التي تصيب أحد أفراده، لأن من حق المضرور ألا يقع أي مساس بسلامة جسده، ومن حق محدث الضرر أن يباشر نشاطه ويأتي الأفعال المشروعة.
