استقر العمل في النظم المعاصرة على الإهتمام بمبدأ إستقلال السلطة القضائية، وعده مبدأ دستورياً وحقاً أصيلاً يرتبط بحماية الحقوق والحريات للمواطنين، ذلك أن طبيعة هذا العمل تقتضي أن تكون السلطة التي تمارسه موسومة بالإستقلال والحياد، فضلاً عن كونه من متطلبات النظام الديمقراطي الحر، ولكي يتم ذلك، لا بد من تحويل النصوص الدستورية المنظمة له إلى تشريعات عادية تفصل في تنظيمه، وإعمال تلك النصوص بما يضمن بسط ولايته على كل ما يدخل قانوناً في وظيفته، وأن تتوافر له مقومات السلطة من تخصص وإستقلال وحيدة، كما ينبغي أن يكفل النظام الدستوري الحيدة السياسية له.
إن مبدأ إستقلال السلطة القضائية، وعلى أهميته الكبيرة، يزداد أهمية عندما يسهم في إرساء نظام دولة القانون الذي يرسي دعائم السلطة، ويساعد على إستتباب الأمن وتثبيت قواعد الإستقرار السياسي.
ولا بد لتحقيق نظام دولة القانون من تنظيم حماية مناسبة تحد من نشاط السلطات العامة المخالفة لقواعد المشروعية، وذلك ممكن عبر صور مختلفة لهذه الحماية، منها الرقابة البرلمانية، والإدارية، فضلاً عن القضائية، التي تعد من أهم تلك الضمانات.
يركز هذا الكتاب على دراسة موضوع إستقلال السلطة القضائية ومدى إسهام ذلك في نظام دولة القانون، وانتخب القضاء الدستوري في دول المقارنة لدراسة تنظيمه الداخلي وإختصاصاته وقراراته، وآثر النحو بإتجاه إعتماد المقارنة ما بين كل من العراق ولبنان ومصر بشكل رئيسي.
