خلال العقود الماضية، كان اهتمام المجتمع الدولي منصباً على إحلال السلم والأمن الدوليين، من خلال تسوية الخلافات بين أشخاص القانون الدولي العام بالطرق السلمية، وكانت المفاوضات إحدى تلك الوسائل المهمة التي يلجأ إليها، إما للحد من إندلاع نزاع مسلح دولي أو للتوصل إلى إتفاقية وقف إطلاق النار تمهيداً لخطوة أخرى تمهد إلى إتفاقية سلام.
وفي السنوات القليلة الماضية، ركز المجتمع الدولي وفي معظم مبادراته على المفاوضات في إطار النزاعات المسلحة غير الدولية، بهدف وغاية محددة، تقوم إما على أسس إنسانية، ويصطلح عليها بالمفاوضات الإنسانية، أو على أسس سياسية تمهد إلى التفاوض بين الحكومات والمجموعات المسلحة، لأجل وقف إطلاق النار وإحلال السلام فيما بينهما، والتمهيد بإتجاه إنتقال سلمي للسلطة والمشاركة فيها على قدم المساواة، ويصطلح عليها بالمفاوضات السياسية.
ولأجل الإحاطة بهذا الموضوع المعاصر، تركز الدراسة ومن خلال مبحث تمهيدي وفصلين، على مراجعة المتغيرات الراهنة للقواعد القانونية الدولية المنظمة للمفاوضات الدولية، مع بيان الأساس القانوني المنشئ أو الكاشف للمفاوضات مع المجموعات المسلحة، فضلاً عن المجموعات الإرهابية وذلك في إطار قواعد القانون الدولي العام والقانون الدولي الإنساني، مع التركيز على تحليل نماذج منتخبة من مفاوضات انتهت بإبرام إتفاقات السلام وفي مناطق مختلفة من العالم، أو في إطار مفاوضات ما زالت مستمرة ولا سيما في منطقتنا العربية التي شهدت نزاعات مسلحة غير دولية، أطرافها قوات نظامية وأخرى مجموعات مسلحة.
