تخرج مفهوم البحار العالية كالبحر الميت وبحر قزوين رغم أن المياه تتسم بالملوحة، إلا أنها لا تعتبر من قبيل أعالي البحار نظراً لعدم قيام الاتصال بينها وبين المساحات الأخرى المغطاة بالمياه المالحة. كما تخرج قناة السويس عن هذا المفهوم كذلك لأن الاتصال بين البحر الأبيض المتوسط والبحر الأحمر لم يكن اتصالاً حراً وطبيعياً وإنما كان الاتصال بفعل الإنسان عن طريق الحفر أي اصطناعياً وليس طبيعياً، وكذلك الحال في قناة بناما التي تم حفرها، ولم تكن كذلك بفعل الطبيعة.
لما كانت السفينة هي الأداة الرئيسية للملاحة البحرية، رأينا ضرورة التجهيز للدراسة بفصل تمهيدي عن السفينة والبحر والتفرقة بين السفينة العامة والخاصة والمركز القانوني لكل منها في المجالات البحرية المختلفة خاصة في المواني التي تثور في شأنها العديد من المنازعات المتعلقة بهروب المجرمين العاديين والسياسيين وموقف السفينة وموقف دولة الميناء وذلك للتفرقة بين اللجوء السياسي وحالات الهروب ومعالجة المواقف المختلفة للسفينة في البحر الإقليمى، ومتى يمكن إيقاف السفينة وتفتيشها واتخاذ الإجراءات القانونية بشأنها في الحالات المختلفة.
أما المقصود بالمضايق البحرية وأنواعها وبالتالي نوع المرور الواجب في كل منها وتحديد مفهوم المضيق وضبطه بعيداً عن مفهوم الخليج فهذا هو موضوع الفصل الثاني من هذه الدراسة. أما الفصل الثالث فقد خصصناه لمناقشة بعض مشكلات الملاحة البحرية في العالم العربي منها مضيق تيران الواقع في جنوب العقبة ومضيق هرمز الواقع جنوب الخليج العربي بالإضافة إلى مضيق جبل طارق.
لذلك تنقسم الدراسة إلى فصول كالتالي: فصل التمهيدي: تعريفات أولية. الفصل الأول: الملاحة البحرية. الفصل الثاني: المضايق الدولية. الفصل الثالث: بعض المشكلات العربية.
