مما يجب ملاحظته أن النظام القانونى للملاحة فى المضايق الدولية والذى نحن بصدد بحثة لم يكن من بنات أفكار هذا العصر ولا طفرة من طفراته، وإنما هو ناتج عن تطور كبير استغرق زمنا طويلا من عمر البشرية. ولأن الواجب يقتضى أن نلقى نظرة على ذلك التطور، ولفهم قواعد الحاضر فهما صحيحاً لابد من الرجوع إلى الماضر أى لابد من أن نتعرف على الاصول الاولى للقانون الدولي العام وان نتبع بعد ذلك الخطى التى خطاها هذا القانون على مر العصور حتى بلغ المرحلة الحالية.
ولذا فاننا سوف نتابع مبدأ البحار بصورة عامة وذلك لأن المضايق جزء من البحار وان الادعاءات التى سادت على موضوع البحار تنعكس آثارها على المضايق بصورة مباشرة ومن ثم نحاول نضيف البحث لنحصره فى الملاحة في المضايق.
وسوف نقسم هذا الكتاب إلى بابين نبحث فى أولهما: النظام القانوني للملاحة فى المضايق، من حيث التعريف بالمضايق الدولية وانواعها والشروط الواجب توافرها لإعتبار المضيق دوليا، وذها ما نخصص ف فى الفصل الأول من هذا الباب، ونتناول فى الفصل الثانى الملاحة فى المضايق التى تخضع للقواعد العامة فى القانون الدولى، أما الفصل الثالث فسوف نخصصه لدراسة الملاحة فى المضايق التى تخضع لاتفاقيات خاصة، أماالباب الثانى، فسوف نبحث فيه حرية الملاحة فى مشيق هرمز، وترى الوضع التاريخى والجغرافى وأهمية للمحلاة الدولية، وهذا ما نخصص له الفصل الاول، أما الفصل الثانى فسوف نتناول فيه وضع المضيق القانونى وحرية الملاحة فيه.
