تثير قضية حرية التعبير جدلاً واسعاً فى دول العالم أجمع وفى الدول العربية بصفة خاصة. وفى مصر نص الدستور فى المواد47, 48 وغيرها على حرية التعبير وملا يتفرع عنها من حقوق مثل حرية الصحافة والحق فى التجمع وحق النقد العمل العام. وقد أثيرت قضايا عديدة فى هذا للمجال شغلت الرأى العام واحتلت مساحات واسعة من الصحف وساحات القضاء, ومنها على سبيل المثال قضية اضراب عمال سكك حديد مصر وقضية نصر حامد أبو زيد وقضية عادل حسين, وقضية د. سعد الدين إبراهيم.
وقد كانت المساحة واسعة لقضايا الرأى والتعبير مثل رواية حيدر حيدر وليمة لاعشاب البحر, روايات وزارة الثقافة, كذا قضية اضراب عمال سكك حديد مصر والأحزاب وفرض الحراسة على نقابة الصحفيين, وتكوين الجمعيات وحلها. لذا فإننا نعرض لهذه الأمور, وفق منهج تحليلى تأصيلى يرد الأمور إلى المستقر من النصوص القانونية وأحكام القضاء.
