أصدرت مؤسسة “حرية الفكر والتعبير” دراسة قانونية مقارنة عن “حرية تداول المعلومات”وهي أول دراسة من هذا النوع تصدر عن المؤسسة في إطار حرصها على التأصيل القانوني لهذا الحق الذي يعتبر أساساً لا غنى عنه لممارسة الديمقراطية تنقسم الدراسة إلى ثمانية أقسام، حيث تبدأ بقراءة حول حرية تداول المعلومات في السياق الدستوري، سواء كان دستور 71 الذي سقط بقيام ثورة 25 يناير، أو الإعلان الدستو أصدرت مؤسسة “حرية الفكر والتعبير” دراسة قانونية مقارنة عن “حرية تداول المعلومات”وهي أول دراسة من هذا النوع تصدر عن المؤسسة في إطار حرصها على التأصيل القانوني لهذا الحق الذي يعتبر أساساً لا غنى عنه لممارسة الديمقراطية تنقسم الدراسة إلى ثمانية أقسام، حيث تبدأ بقراءة حول حرية تداول المعلومات في السياق الدستوري، سواء كان دستور 71 الذي سقط بقيام ثورة 25 يناير، أو الإعلان الدستوري بعد الثورة، وتنتقل بنا الدراسة بعد ذلك إلى تناول قضية حرية تداول المعلومات ، في ضوء قواعد القانون الدولي لحقوق الإنسان والأنظمة القانونية المقارنة .
أما القسم الثالث في الدراسة فيستعرض \”حرية تداول المعلومات\” في ظل القوانين والتشريعات المصرية وما ترتب عليها من آثار بين \”الإتاحة والحجب\” للمعلومات،سواء على مستوى الوثائق التاريخية ، أو الصحافة ، أو غيرها من المعلومات المتداولة بشكل يومي، وينتقل بنا القسم الرابع ، إلى بعض المفاهيم ذات الصلة بقضية تداول المعلومات كالسرية والأمن القومي بوصفهما من أشهر الاستثناءات التي ترد على هذه الحرية .
أما القسم الخامس، فقد تم تخصيصه لبعض التطبيقات القضائية ، على أهم القضايا التي تناولت مفهوم حرية تداول المعلومات في مصر، وتتناول الأقسام الأخرى للدراسة بعد ذلك ، نموذجين هما الهند والأردن، كمثالين لدولتين لديهما قوانين لتداول المعلومات مع إلقاء الضوء على الايجابيات والسلبيات التي ينطوي عليها كل قانون ..
وتهدف الدراسة إلى تقديم رؤية قانونية للإشكاليات التي تنطوي عليها التشريعات المصرية فيما يتعلق بالقيود التي تفرضها على تداول المعلومات ، ومدى اتساقها مع المعايير الدولية بهذا الصدد ، خاصة ونحن على أعتاب سن تشريع جديد لحرية تداول
المعلومات في مصر ، مما يستوجب من مؤسسة حرية الفكر والتعبير في إطار الدور الحقوقي المنوط بها ، أن تقدم مساهمتها بهذا الصدد
