يهدف هذا البحث إلى تكوين صورة قانونية واضحة عن الوسائط المتعددة فيما بين واقعها التقني بوصفها منتجاً يقدم خدمة من بين منتجات باتت تغزو الأسواق بالوسائل الإعلامية الحديثة وبين قوانين حماية حقوق الملكية الفكرية بوصفها مصنفاً يتضمن ابتكارات فكرية تتسم بالتعقيد، وتتم بوسائل الدمج الإلكتروني بواسطة تقنيات بالغة الدقة.
وتعتبر الوسائط المتعددة كمصنف باكورة الأشكال للإبتكارات بما تحتويه من إبداعات تقنية يغدو على مستوى القانون التأكد من أصالتها، وقد اتخذنا هذا المصنف نموذجاً يستاهل التدبر في كنهه القانوني سواء منذ أول نبضة إلكترونية تساهم في إنشائه إلى تمام تكونه، وذلك في محاولة لتحديد ماهيته القانونية وخصائصه إلى المشكلات المتعلقة بتطبيقاته وذلك فيما بين الواقع والقانون.
وتعد إشكالية هذا المصنف صدى للإشكالية الكبرى على الصعيد الدولى والخاصة بالتقنيات الرقمية "الإلكترونية" والتي يقال بصددها أنها قلبت المعطيات الأساسية لحقوق المؤلف رأساً على عقب.
وعلى الرغم من اللبس الكبير الذي يحيط بمصطلح "الوسائط المتعددة"، فإننا لن نتعرض في هذا البحث إلا إلى فكرتين مترابطين: الفكرة الأولى: محاولة تحليل ما هو ماثل أمامنا من واقع تشريعي يتعلق بالوسائط المتعددة سواء بطريق مباشر أم غير مباشر وذلك بوصفها مصنفاً محمياً.
والفكرة الثانية: محاولة بيان أوجه الشبه والخلاف بين مصنف الوسائط المتعددة والمصنفات الأخرى لعلنا بذلك نتدبر في ذاتيتها وتحدد المقصود بها قانوناً، وعلى هذا نقسم دراسة هذا الموضوع إلى ثلاثة فصول على النحو التالي: "الوسائط المتعددة كمصنف يحميه القانون، الوصف القانوني لمصنف الوسائط المتعددة، إشكالية مصنف الوسائط المتعددة تطبيقاً".
