فرضت مسائل "حقوق الإنسان" نفسها على المجتمعات الإنسانية بمختلف أشكالها وتوجهاتها، وأصبحت جزءاً أساسياً من المشهد السياسي أن على الصعيد الوطني الداخلي أو على صعيد المجتمع الدولي ومؤسساته وهيئاته.
وقد شكّلت فترة ما بعد الحرب العالمية الثانية بداية مرحلة تصاعد الإهتمام بمسائل حقوق الإنسان حيث جرى تكريس المفاهيم بنصوص دولية والبحث في إنشاء أجهزة فوق - دولتية supra - national تؤمّن ضمانات التطبيق العملي والحماية الفعلية.
وجدت أنظمة الحكم في المنطقة الممتدة جنوب المتوسط من المحيط حتى أعماق آسيا، وجدت نفسها، رغماً عنها، في خضم هذه الورشة العالمية، فحاولت مسايرة التيار على مضض، والتعامل مع هذا الواقع كعادتها في حالات مماثلة: الترحيب ظاهرياً والتفخيخ فعليا، وكان هذا الموقف من قِبلها بمثابة تكرار لما فعلته في مواجهتها لقضايا "الديمقراطية": بناء الهياكل المؤسسية وتفريغها من محتواها.
لم تستوعب هذه الدول جوهر فلسفة "حقوق الإنسان" المرتكزة أساساً على إقامة نوع من التعايش المتوازن بين السلطة في المجتمع وبين حقوق الأفراد عن طريق إخضاع طرفي المعادلة للقانون.
تعاملت مع الموضوع وكأن "الحقوق" هي عبارة عن تناول من قبل السلطة عن بعض إمتيازاتها لصالح الأفراد، يجب أن تشكر عليه.
اعتبرت الإعتراف بالحقوق وحمايتها مسائل ثانوية، بل ترف، وليس ضرورات وحاجات أساسية.
