صحيح أن القوانين المتطورة ومزودة بمفاهيم حقوق الإنسان تلعب دوراً بارزاً في إستقرار سلم الإجتماعي في جميع النواحي، لكن ما جدوى القوانين المتطورة إذا لم يتمسك بها السلطات السياسية في أي دولة.
إذ أخلاقيات السلطة السياسية هي الأساس والتي تلعب دوراً بارزاً في إحترام الحق في حرية الرأي والتعبير بشتى مكوناته، حتى ولو كانت القوانين أخذت بنظام التراخيص لأن السلطة السياسية حينذاك تقوم بتفسير تلك القوانين بما يخدم المواطنين وحقهم في التعبير، وبالعكس إذا كانت القوانين متطورة قد تعمد السلطة السياسية بالقيام بتفسير ضيق بما يخدم مصلحتها، وهذا هو حال الدول البوليسية.
أن ممارسة الحق في حرية الرأي والتعبير ضرورية، وفي الوقت نفسه فإن فرض القيود عليه لغرض تنظيمه الموضوعي يعد أمراً ضروريّاً، وفي كلتا الحالتين الضرورات تقدر بقدرها.
وبناءً على ما تقدم أن هذه الحرية غير مطلقة فقد أخضعت للعديد من القيود بموجب الشرعة الدولية لحقوق الإنسان، كإحترام حقوق الآخرين وسمعتهم وحماية الأمن الوطني أو النظام العام أو الصحة العامة أو الآداب العامة.
ورغم أنه تم وضع نصوص كضوابط لتحديد تلك القيود بغية عدم التوسع فيها، لكن لاحظنا أن تلك النصوص أيضاً لم يحدد معناها بشكل كافٍ ووافٍ، وصيغت بعبارات ضبابية ومطاطية، وهي الأخرى خاضعة لتأويلات مختلفة حسب الأفكار والمعتقدات والإعتبارات السياسية في كل مجتمع، وهذا أصبح ذريعة بيد المشرعين بشكل عام للتوسع في نطاق تلك القيود، وصدور قوانين مجحفة بحق حرية الرأي والتعبير.
وهو ما دفعنا إلى التفحيص في تلك القوانين بغية الوقوف على حقيقة الأمر، والبحث في التعريف بالقيود الواردة على حرية الرأي والتعبير، ومن ثم مظاهر حرية الرأي والتعبير وأبرز القيود الواردة عليه بشكل عام، وبالأخص في المواثيق الدولية وفي تشريعات إقليم كوردستان - العراق النافذة.
