تعدّ الدعوى العامة (العمومية) وسيلة الدولة في ممارسة سلطتها بفرض العقاب على المجرمين، فكل جريمة ينشأ عنها في الغالب حق للمجتمع في عقاب الجناة. وإذا كان حق المجتمع في معاقبة المجرم يتولد بمجرد وقوع الجريمة.
فإن ارتكاب المجرم لجريمته لا يستلزم توقيع العقوبة تلقائياً، بل يجب أن يسبق ذلك اتخاذ الطرق التي تكفل للمجتمع حقه في فرض العقاب على المجرم مع إعطائه كافة الحقوق والضمانات للدفاع عن نفسه. ولما كانت الجريمة تمثل اعتداء على المجتمع بأسره، أصبح له الحق في معاقبة فاعلها فهو صاحب الدعوى العامة، ولأنه ليس باستطاعة المجتمع أن يقيمها ويتابعها، فهو يفوض النيابة العامة القيام بهذه المهمة. وهي تقيم دعوى الحق العام وتباشرها باسم المجتمع، ونيابة عنه، ولا تقام من غيرها إلا في الأحوال التي بيّنها القانون.
والنيابة العامة في سبيل تحقيقها لأداء مهمتها التي أناطها بها المجتمع تعد خصماً في الدعوى، هدفها الأساس المطالبة بإيقاع العقاب الذي فرضه القانون. أمّا إذا تبين لها بعد الانتهاء من مرحلة التحقيق الابتدائي أنه لا وجه للاستمرار بدعوى الحق العام ضد المشتكى عليه قررت منع محاكمته ووقف السير بإجراءات الدعوى عند الحد الذي وصلت إليه.
وإذا كان من مصلحة المجتمع إيقاع العقاب المناسب بحق الجناة، فإن من مصلحته أيضاً ألا يوقع أي عقاب أو تدبير من شأنه المساس بكرامة أي شخص بريء أو الحد من حريته، وذلك إعمالاً لمبدأ أن الانسان بريء حتى تثبت إدانته فلا يجوز أن يبقى هذا الشخص مهدداً باتخاذ إجراءات مقيدة لحريته حتى إحالة القضية إلى المحكمة وصدور قرار براءةٍ بحقه فعلى النيابة العامة التحقيق في الدعوى لتحديد مدى صلاحية نظرها أمام قضاة الحكم، فإن ترجح لديها إدانة الجاني أحالته إلى القضاء ليتولى سلطة الفصل فيها.
