إن تطور الأحداث على الساحتين العلمية والتشريعية يفرض علينا أن نتعامل مع معطيات هذا التطور حتى نلاحقه بسرعة ونسير في ركابه بشرط أن نكون على معرفة بمواضع أقدامنا وما إذا كانت على بصيرة أو على غير هدى، ومن الأمور العلمية التي استجدت على الساحة البحثية موضوع "التلقيح الصناعي" وذلك كوسيلة للتغلب على عجز الزوجين أحدهما أو كليهما عن إتمام عملية الإخصاب اللازمة لإنجاب الأطفال لذلك كان لزاماً على الباحثين في الطب والقانون أن يدولوا بدلوهم ويتقدموا بأبحاثهم لكشف الحقيقة والإجابة على سؤال هام جداً في هذه الحالة وهو: مدى مشروعية أو جواز هذه التقنية الحديثة؟، فإذا كان علماء الطب قد أجابوا بالإمكان العلمي وجرت التجارب التي أسفرت عن تمام نجاح العملية فقد وجب على علماء القانون أن يجيبوا عن مدى جواز هذا الإجراء قانوناً وأيضاً ما حكم الشريعة الإسلامية، وذلك لتحديد ما يتناسب ويباح من الوجهة القانونية ومالا يمكن إباحته.
ولما كان التلقيح الصناعي من الوسائل الهامة التي تساعد كأسلوب علمي حديث على حل بعض مشاكل العقم لدى الزوجين مما يساعد على حقهما في تكوين أسرة، ومن ثم فقد وجب بحث هذه التقنية الحديثة للوقوف على مدى مشروعيتها ومطابقتها للقانون والشريعة خاصة أنه لازال استعمالها موضع خلاف بين فقهاء الطب والقانون والشريعة، وقد رأيت أن أسلك من جانبي هذه المشاكل الشائكة في هذا البحث.
