العقود الهندسية تعتبر من العقود ذات الطبيعية الخاصة التى تقوم على اعتبارات فنية بحته حيث تتضمن هذه العقود قيام المتعاقد بتقديم الخبرة والاستشارة الفنية لإنجاز العمل المطلوب ويراعى في اختيار المتعاقد اعتبارات شخصية بحتة مردها جميعا إلى سمعته وكفاءته النفية والأعمال التى سبق له القيام بها ولذلك فإنه من غير الملائم اتباع الاجراءات التى رسمها القانون رقم 236 لسنة 1954 بتنظيم المناقصات والمزايدات وأحكام لائحة المناقصات والمزايدات الصادرة بقرار وزير المالية والخزانة رقم 546 لسنة 1957 عند التعاقد في هذا النوع منا لعقود إذ ان الكشف عن الكفاية الفنية والخبرات والمجالات الخاصة التى تتوافر في بعض المتعاقدين لا يتأتي باتباع أساليب تعاقد الإدارة التى نظمها قانون ولائحة المناقصات والمزايدات وإنما تلجأ الإدارة بما توفر لديها من المعلومات عن كفاية المتعاقد وسمعته والأعمال التى سبق له إنجازها.
