وسوف يتبين للقارئ من خلال هذا البحث أننا سنعتمد على مصادر الشريعة في استخلاص القواعد والأحكام، دون أن يكون هدفنا هو محاولة تطويع الشريعة الإسلامية لكي تتفق أو تتشابه مع النظريات القانونية المختلفة، وذلك لأن النظريات الإسلامية لن تزيد فضلًا ولا كمالًا إذ ما انتهت إلى ذلك ويرجع إلى أن الشريعة الإسلامية تستمد أصالة جوهرها ودقتها وإحاطتها بكافة أوجه المجالات البشرية من صاحب الكمال المطلق الله عز وجل.
