يحاول هذا البحث أن يتلافي في منهجيته ما وقعت فيه عشرات الكتب والمقالات التي تناولت القضية نفسها، وهي قضية تجديد الخطاب الديني، والفقهي خاصة. معظم من تناولوا هذا الملف قد توقفوا في تناولهم عند الشكوى وإظهار التألم من حال المؤسسة الفقهية والتسابق على الإيتان بما لم يكتشفه الآخرون من أعراض وهنها. ولكن لم يتطرق أحد لمحاولة طرح أفكار وبدائل وحلول (سوى البديل العلماني بإقصائها). إذاً ما يريده هذا البحث هو تجاوز مرحلة النقد إلى مرحلة البحث عن مخرج لأزمة طالت واستحكمت حلقاتها.
تحت هذا العنوان المثير حشدت المؤلفة عدداً من التساؤلات الكثير التي بدأ المثقفون يطرحونها مع التغيرات الاجتماعية والسياسية والاقتصادية، ومع المستجدات الخطيرة في الحياة اليومية للمسلمين.
وسكت الفقهاء، فلم يجيبوا عن هذه التساؤلات، لا لنقص في الشريعة السمحة، وإنما لظروف تتحدث عنها المؤلفة بأسلوب شيق جرئ.
الكتاب يلقي بقعاً من الضوء على زوايا مظلمة، يجب أن ننتبه إليها.. و تدعو إلى تجديد الخطاب الإسلامي على أسس متينة واضحة بينة.
