إن الضرر في القانون الدولي يعد شرطاً أساسياً لقيام المسؤولية الدولية، ووفقاً للقانون الدولي التقليدي ينجم هذا الضرر عن نشاط غير مشروع دولياً، إلا التطورات العلمية والتكنولوجية حملت معها نشاطات غير محظورة دولياً كالأنشطة الصناعية وإستغلال مجاري المياه الدولية.
بالإضافة إلى نشاط الشركات المتعددة الجنسيات والنقل البحري وتجارب الأسلحة النووية، سببت أضراراً لدول أخرى غير الدول التي نفذ فيها النشاط.
نتيجة لذلك برز مفهوم جديد للضرر هو الضرر العابر للحدود الذي يتسبب بأضرار قد تفوق في نتائجها الأضرار التي تنجم عن فعل غير مشروع دولياً.
فكان للقانون الدولي موقفه للحد من هذا الضرر وأكد على أن سيادة الدول على إقليمها لم تعد مطلقة فلا بد من إستخدام إقليمها بالشكل الذي لا يتسبب بالضرر لدول أخرى.
نتيجة لذلك تضافرت الجهود على المستوى الإقليمي والعالمي ومن خلال المنظمات الدولية لمعالجة هذا الضرر، وذلك من خلال عقد الدول للعديد من الإتفاقيات الدولية التي بدورها تقوي وتعزز دور المنظمات الدولية لإيجاد الحلول ضمن إطار العمل الجماعي للحد من هذا الضرر ودعوة الدول للتعاون فيما بينها لدراسة الأنشطة التي تروم القيام بها على إقليمها إذا ما كان لها أثر سلبي على غيرها من الدول قبل بدء العمل به.
قسم البحث على أربعة فصول: تناول الفصل الأول الضرر العابر للحدود في القانون الدولي، أما الفصل الثاني فقد تناول ماهية النشاطات غير المحظورة في القانون الدولي، أما الفصل الثالث فقد خصص لبيان الجهود الدولية في معالجة الضرر العابر للحدود، وخصص الفصل الرابع والأخير لتناول الإلتزامات المترتبة على الضرر العابر للحدود.
ولقد ختم البحث بخاتمة تضمنت إستنتاجات ومقترحات في ما يتعلق بالموضوع مدار البحث.
