يبين لنا التاريخ بأن الجماعات الإنسانية لها القدرة والحاجة على الدخول في علاقات قانونية – سياسية مع بعضها البعض، وأن تتجمع في وحدة واحدة لتحقيق أهداف عامة مشتركة، وأن تقوم بإنشاء المؤسسات للتعبير عن هذه الإرادة، وكذلك تتمسك بهيئاتها وبتكيفها مع الإطار العام للعيش السلمي وتحقيق المصالح المشتركة، ومن أجل ديمومتها تنظم السلطات في كل منها لتجسد أهدافهم وطموحهم في ظل كيان دستوري قانوني في الواقع العملي.
وتترتب على تفكك الإمبراطوريات القديمة في أوروبا قيام وحدات سياسية نشأ بين شعوبها نوع من الوحدة في التاريخ وشعور مشترك بمصير واحد، ولهذا اتجهت إلى إنشاء دول قومية مستقلة وموحدة، وتطور هذا الشعور إلى توحيد الوحدات السياسية المتناثرة في دولة موحدة تقوم على أسس قانونية واضحة.
وقد حاولنا في هذه الدراسة أن نخوض في المجال الدستوري الفدرالي وتحديده انطلاقاً من النظريات الأساسية التي يستند عليها الفكر الدستوري الفدرالي، ومما استقر عليه الدستور الفدرالي من العمل والممارسة، وكذلك فيما يطرأ عليه من تغيرات وتبدلات من خلال العمل الذي يقوم به القاضي الدستوري، ومن خلال تعامل رجل السياسة على المبادىء الدستورية الفدرالية كلما وجدت الفرصة بذلك، ومن خلال المساومات والصراعات السياسية التي تشهدها السلطات بين الحكومية في الدولة الفدرالية، وهذا يتأثر على الوضع الدستوري للدولة الفدرالية وذلك في ديناميكية السلطات والإختصاصات بين السلطات الفدرالية وسلطات الدول الأعضاء. هذه المقاربة مؤسسة على اعتماد الإجتهاد القضائي والمراس الحكومي، كمرجعين حاضرين دوماً في كل تحليل من أجل استحضار ديناميكية المواد الدستورية الفدرالية وروحها العملية.
