يهدف البحث إلي الكشف عن معالم نظرية عامة، لا تستمد معطياتها من التشريعات القائمة فحسب، بل ومن معطيات السياسة الجنائية المعاصرة التي يرتكز عليها القانون الجنائي، حتى يمكن من خلال تلك النظرية التوصل إلى نموذج يصح الاهتداء به في تطبيق نظام الصلح الجنائى، من أجل المساهمة في تجاوز أزمة العدالة الجنائية، التي تعانى منها كافة المجتمعات الإنسانية علي إختلاف توجهاتها.
ويثير موضوع الصلح في المواد الجنائية العديد من المشكلات، فمن المعلوم أن فروع القانون المختلفة تحيا جميعها في حالة تكامل، فالصلح بصفة عامة يجد جذوره في نطاق القانون الخاص، وعلى وجه الخصوص في نطاق القانون المدنى، ولذا تأثر الفقه والقضاء في تحديد ماهية الصلح الجنائى بالطبيعة العقدية.
ومن ثم أضحت تلك الطبيعة بادية علي ملامح أحكام الصلح، حيث تقيدت شروطه وآثاره بأحكام العقد المدنى. بيد أن الصلح محل البحث يتعلق بالدعوى الجنائية، ومن هنا كان من الضرورى أن يتفرد بذاتية خاصة، تجعله مستقلاً ومتميزاً في طبيعته وأحكامه.
ويثير البحث كذلك فكرة التصالح مع الأشخاص المعنوية، ومايصاحب ذلك من بعض المشكلات، التي نجمت عن الفكر المعارض لإقرار مبدأ المسئولية الجنائية للأشخاص المعنوية، حيث يفترض الصلح الجنائى ثبوت تلك المسئولية إبتداء، حتى يمكن الخوض في غمار البحث عن إمكانية تطبيق الصلح أو التصالح. وإن كان العديد من التشريعات ومنها قانون العقوبات الفرنشى الجديد قد اتجهت مؤخراً إلى إقرار مبدأ المسئولية الجنائية للأشخاص المعنوية.
وأخيراً فقد اقتصرت في تناول مايثيره البحث من مشكلات على أهمها، وإن كنت أعتقد أن الصلح الجنائى لا يتعارض مع المبادئ المستقرة في نطاق القانون الجنائى، التي تعد من مستلزمات الخصومة الجنائية، أو بالأحرى من لوازم إدارة الدعوى الجنائية بالطريق التقليدى فالصلح طريقة غير قضائية لإدارة الدعوى الجنائية، بضمان سلطان القانون.
